A central question that arises when interpreting the U.S. Constitution is which theory of interpretation is the best? In his recent book, “How to Interpret the Constitution,” Cass Sunstein reviews various theories of constitutional interpretation currently in vogue and then offers what he believes would be the best approach going forward. In this Article, I want to take up a more basic question presupposed by the very idea of a theory of interpretation. That is, whether it is even possible to (...) arrive at more than a provisional understanding of what would be the best interpretation in any given area of study, including constitutional law. That said, I do believe some of the interpretations suggested by Cass Sunstein and elsewhere by myself and others to be more persuasive than most others, even if only partially so. For, as Sunstein himself points out, no theory seems perfect to figure out the Constitution’s meaning in every possible world in which we could imagine it to exist. So, we best just focus on our own world or what we take to matter in our world. In keeping with this idea, I plan to begin by looking first at how we might interpret the world around us based on our past experiences by considering a somewhat imaginative recent experience of my own. Next, I consider some recent studies in the neurosciences and a previous but highly influential article by the philosopher Donald Davidson concerning conceptual schemes and whether we could ever hope to make any sense of a scheme radically different from our own. Here it should be pointed out that I will use the word “scheme” when referring to a very broad system of thought for which there may not be much outside, versus when I use the word “framework,” as referencing something far narrower than a whole system of thought, even if what is referenced might purport to be a significant part of a still larger system. My goal is to eventually adopt John Rawls’ public reason method to separate out non-workable systems of thought as might be part of a particular religious or philosophical tradition that cannot be easily tied to any other system of thought easily imagined within a pluralistic society. I plan to do this by relating how Rawls’ public reason might allow for the creation of a moral interpretation of the Constitution adopting the moral theory of Alan Gewirth. The latter I adopt because its grounding does not presuppose any prior moral or religious framework. I then apply that interpretative method to five cases Sunstein believes are fixed points in our current constitutional understanding. In short, I plan to isolate out an area of human rights where even very different understandings of the world might be able to meet, while acknowledging that there will still be other areas that simply evade any common connection. I hope what I offer here to be of help for a theory of constitutional interpretation that focuses on morality, without having to compete with various religious frameworks going forward. (shrink)

In this article I review the Supreme Court’s current use of its major questions doctrine to see if the justifications commonly offered for its existence can explain its current use. In the process of doing so, I examine what the doctrine is about, how it came into existence and how the Court has applied it, especially in context to two recent cases, West Virginia v. EPA and Biden v. Nebraska. As both of these cases implicate the regulatory state, I place (...) the primary focus of this article on how the doctrine should apply in context to judicial evaluation of the regulatory state. In so doing, I discover that the Court’s current reliance on constitutional separation of powers and checks and balances analyses seem too narrow both with respect to the concerns of the founding generation but also, and perhaps more importantly, to the Constitution’s goals for the kind of government it sought to establish going into the future. Abstract: In this research, an Artificial Neural Network (ANN) model was developed and tested to predict temperature in the surrounding environment. A number of factors were identified that may affect temperature or humidity. Factors such as the nature of the surrounding place, proximity or distance from water surfaces, the influence of vegetation, and the level of rise or fall below sea level, among others, as input variables for the ANN model. A model based on multi-layer concept topology was developed and (...) trained using data from several regions in the surrounding environment. The evaluation of testing the dataset shows that the ANN model is capable of correctly predicting the temperature with 100% accuracy. (shrink)

West Nile virus (WNV) is a mosquito-borne flavivirus that was first identified in 1937 in the West Nile district of Uganda. The virus is now widely distributed throughout the world and is considered a significant public health concern. WNV is primarily transmitted to humans through the bite of infected mosquitoes, with birds serving as the primary reservoir host. Most people infected with WNV will not experience any symptoms, but approximately 1 in 5 will develop a fever, and a smaller percentage (...) may develop more severe symptoms such as meningitis or encephalitis. There is no specific treatment for WNV infection, and prevention efforts focus on mosquito control measures and personal protective measures to avoid mosquito bites. While WNV is not typically considered a major threat to human health, outbreaks have occurred sporadically in various parts of the world, and ongoing surveillance and research are necessary to better understand and control the virus. Objectives: This paper will solve the problems of treatment of West Nile virus (WNV) through correct diagnosis and treatment. Methods: In this research, we provide an expert system for the diagnosis of West Nile virus (WNV) which will help doctors to explore everything related to the problems of West Nile virus (WNV). In this paper, a complex non- linear programming problem with the two parts (real and imaginary) is considered. The efficient and proper efficient solutions in terms of optimal solutions of related appropriate scalar optimization problems are characterized. Also, the Kuhn-Tuckers' conditions for efficiency and proper efficiency are derived. This paper is divided into two independently parts: The first provides the relationships between the optimal solutions of a complex single-objective optimization problem and solutions of two related real programming problems. Abstract: The objective of this study was to evaluate water productivity of alfalfa (Medicago sativa) under centre pivot irrigation system. The experimental works were conducted at three centre pivot irrigation projects (Indian, Arab Authority for Agricultural Investment and Development (AAAID) and Sedonix projects) located at Khartoum State during the period from April 2011 to April 2013. In each project, three irrigation systems were randomly selected for the study treatments. Crop water requirement was obtained using CROPWAT 8 computer model. The parameters (...) tested were Christiansen coefficient of uniformity (Cu%), distribution uniformity (Du%), Scheduling uniformity (Su) and Water productivity (kg/m3). SAS (statistical package) was used to analyze the data. The variations among means were checked by the least significant difference (LSD). The results showed that Cu%, Du%, Su and water productivity significantly affected by the management practices in different irrigated projects. Sedonix project gave the highest values of hydraulic characteristic (Cu 85%, Du 81% and Su 1.23) while AAAID project recorded the lowest values (Cu 74%, Du 70%, Su 1.43). Water productivity significantly increased in Sedonix project (0.45 kg/m3/cut) followed by Indian projects (0.38 kg/m3/cut) and AAAID which ranked the least (0.27 kg/m3/cut). It is concluded that for improvement water productivity; proper technical guidelines for system management, operation and scheduling should be followed. (shrink)

Objectives: To explore individuals’ perception of the personal, family and societal educational needs following a spinal cord injury. Methods: Sixty-one patients who sustained a traumatic SCI between March 2015 and June 2016 referred to Brain and Spinal Cord Injury Research Center were included in a cross sectional study and completed an online survey containing open-and closed-ended questions, in Iran. Participants’ responses were analyzed i using a qualitative approach with a thematic analysis. Results: Following a thematic analysis of the patient’s perceived (...) educational needs, 3 themes and 14 subthemes were identified. The 3 themes included personal, family, and societal educational perceived needs. Within personal educational needs, there were 7 subthemes which included personal independence and transportation, financial independence, life skills modification, knowledge about SCI, prevention of SCI complications, relationships and sexual function, and psychological adjustments. Among family educational needs, the 3 subthemes were caregiver skills and communication, first aid and emergency skills, and emotional and psychological support. For societal educational needs, the 4 subthemes described were social integration, interpersonal communication skills, SCI awareness and injury prevention, sympathize while avoiding pity. Conclusion: According to our findings, people with SCI have various needs that need to be addressed. Educational support should be a part of a comprehensive rehabilitation program and geared towards addressing the patients’ personal and family needs, while educating the community about SCI in order to allow for reintegration into society. Current evidence supports how deviant behavior can be predicted by sociodemographic factors, subjective well-being, and perceived religiousness. However, there is limited research when it concerns specificity such as Muslims justifying deviant behavior, and their subjective well-being and perceived religiousness within a single study. Most studies used Christian population or using a non-denominational approach. Therefore, in this study, data from World Value Survey Wave 6 was used to examine the Muslim population (N = 20,559) and deviant behavior justification. Sociodemographic factors, subjective (...) well-being (life satisfaction, happiness, and state of health), and perceived religiousness (prayer frequency and importance of God in life) were hypothesized as predictors. Results revealed that these hypotheses are supported. However, many of these predictors are weak, having minimal effect. This is with the exception of having the worldview of God being important in one’s life, being both a strong and statistically significant predictor of deviant behavior justification. The more a person views God being important in life, the more it predicts a decrease in deviant behavior justification. This research provides a novel finding on the belief-behavior nexus, specifically concerning Muslims justifying deviant behavior when two forms of perceived religiousness—ritualistic and worldview—are being compared. This paper attempts to rethink the philosophy of Muhammad Iqbal (1877–1938) and challenge the still prevailing tendency in Iqbal scholarship to view it merely as an outcome of the influence of the ideas of various Western/European philosophers. I present Iqbal’s arguments in their particular historical and intellectual context to show that they developed in response to a specific philosophical problem and that Iqbal looked for a solution to that problem in Islamic tradition. I suggest that Iqbal’s philosophy is best understood (...) in the context of, and as a response to, the problem of nihilism as it was debated in modern German philosophy during ‘the pantheism controversy’ in the eighteenth and nineteenth centuries. To demonstrate this, I analyse Iqbal’s article on ʿAbd al-Karīm al-Jīlī to show his concern with the problem of nihilism, and his solution to it based on al-Jīlī’s Sufism. (shrink)

The Lumad struggle in the Philippines, embodied in its various indigenous peoples (IPs), is still situated and differentiated from modern understandings of their plight. Agamben notes that the notion of ‘people’ is always political and is inherent in its underlying poverty, disinheritance, and exclusion. As such, the struggle is a struggle that concerns a progression of freedom from these conditions. Going over such conditions means that one shifts the focus from the socio-political and eventually reveals the ontological facet of such (...) knowledge to reveal the epistemic formation of the truth of their experience. It is then the concern of this paper to expose the concept of freedom as a vital indigenous knowledge from the Mamanwa of Basey, Samar. Using philosophical sagacity as a valid indigenous method, we interview ConchingCabadungga, one of the elders of the tribe, to help us understand how the Mamanwa conceive freedom in the various ways it may be specifically and geographically positioned apart from other indigenous studies. The paper contextualizes the diasporic element and the futuristic component of such freedom within the trajectory of liberation. The Mamanwa subverts the conception of freedom as a form of return to old ways and radically informs of a new way of seeing them as a ‘people.’ It supports recent studies on their literature that recommend the development of their livelihood rather than a formulaic solution of sending them back to where they were. The settlement in Basey changes their identification as a ‘forest people’ into a more radical identity. (shrink)

The aim of the study is to develop theoretic and methodological recommendations and practical activities for the positive social, managerial, organizational and economic development of historical and cultural tourist destinations. In theoretical terms: the role of historical and cultural tourist destination in the development of the region has been established; the historical and cultural tourist destinations have been identified; the author’s classification of historical and cultural tourist destinations has been developed basing tourist visiting activeness; the author’s methodological approach to the (...) diagnosis and creating tools for development of historical and cultural tourist destinations, comprehensively taking into account resource and factor components, has been presented. In practical terms: variations of the activities aimed at the positive development of historical and cultural tourist destinations have been proposed; the description of measures aimed at the creation of a historical and cultural complex on the example of the designed historical and cultural complex “Stara Samar” has been given. The results of the study are applicable for a wide range of historical and cultural tourist attractions: territories, landscapes and elements of landscapes, historical settlements, parks, film studios, historical and cultural heritage sites, history and culture monuments, burial sites, places of worship, sites of social cultural infrastructure. The author’s recommendations provide obtaining commercial results and ensuring a social and cultural effect for businessmen, managers, local communities in the management of existing or in the creation of new historical and cultural tourist destinations. The Mamanuas of Basey, Samar have been in an itinerant state since the 1950s. Their indigenous experience can be capped in the term ‘diaspora,’ which pictures their plight as dispersive habituation, moving from town to town away from their homeland. In a recent study which this paper hinges upon, the concept of diaspora can no longer work and is argued to imperatively function as a vanishing mediator so that indigeneity must come to mean as a constant identity of becoming. Following from such a theoretical lens, this paper delves again into the concept of ‘diaspora’ in the Mamanuan indigenous experience to argue further that its act of mediating functions as performative indigeneity. To do this, the paper runs in three parts: first, it plots the Mamanuan diaspora experience; second, it briefly reiterates the core argument of diaspora as vanishing mediator; and finally, it theorizes on a concept of what Judith Butler calls ‘performative indigeneity’ that takes its form from the mediation of an indigenous diaspora experience. Extensive scientific, philosophical and artistic activities were carried out in the Islamic World’s various science and civilization centers during the early Middle Ages. In these centers, noteworthy works of mathematics, astronomy, geography, medicine, pharmacology, optics, botany, chemistry and other fields of science, which would later determine improvement paths for these fields, were created. Abu al-Izz Ismail ibn al-Razzaz al-Jazari (12th-13th centuries), was a magnificent Muslim scientist known for his work named The Book of Knowledge of Ingenious Mechanical Devices (Kitab fi (...) ma‘rifati’l-hiyal al-handasiyya) and he was born in geography where many scientists were trained. He contributed to the development of science and civilization, the joint legacy of humanity and demonstrated his true capability and success in the field of ilm al-hiyal (the scientific field which addresses the information and practices regarding mechanical technology and engineering in Islamic science history). From this perspective, it is evident that al-Jazari had a wide field of interest, made his mark in the age he lived in with his brave and innovative ideas, and was a wise engineer. al-Jazari’s detailed descriptions and explanations of water clocks, oil lamp clocks and water pumping machines, as well as their construction, were astounding. In addition, al-Jazari’s studies on metal casting techniques, cone valves, wheel balance and the real-world use of aspiration tubes are important in contemporary engineering studies. When all these are considered, it becomes clear that his designation as the “Leonardo da Vinci of the Islamic World” is not a coincidence. Many studies on al-Jazari’s scientific legacy have been conducted in various parts of the world. There are various manuscripts of his aforementioned book. Based on these manuscripts, the work has been -fully or partially- translated into many languages, including Turkish. The German and English translations served as a basis for studies on al-Jazari in other languages. In recent years, studies conducted on al-Jazari in Türkiye (books, articles, domestic and international symposiums, congresses etc.) have demonstrated his brilliance and competence as a scientist. Furthermore, studies on al-Jazari are still ongoing in Türkiye. As for Russia, the scientific legacy of the scientists raised in the Islamic World such as Avicenna, al-Farabi, Abu Bakr al-Razi, Abu Rayhan al-Biruni, Abu al-Qasim al-Zahrawi, Muhammad ibn Musa al-Khwarizmi, al-Battani, al-Kashi, Abd al-Rahman al-Khazini, Nasir al-Din al-Tusi was researched within the scope of a special plan and program. Depending on the relevant studies, al-Jazari and his work drew attention as well. A small portion of the aforementioned Russian studies is known in Türkiye. It is safe to assume that al-Jazari studies in Russia are virtually unknown in Türkiye. The present study primarily aims to contribute to the literature on the scientific legacy of al-Jazari, a Middle Age Islamic scientist best known for his famous work in the mechanical field. More specifically, the present study aims to: 1) to identify the studies on al-Jazari in Russia, and in the former USSR countries, where academic studies are still in Russian after the Soviet Union period, to create a chronological biography and to set forth their compilation; in other words, to create a bibliography which includes Russian studies on al-Jazari; 2) to provide information on the structure and content of the studies in question, to detect the methodological issues encountered in these works, and make solution recommendations to solve these issues; 3) to contribute to continuing and future studies in Türkiye on al-Jazari in terms of source and material index. In conclusion, it should be stated that comparative reading was conducted centered on The Book of Knowledge of Ingenious Mechanical Devices (Kitab fi ma‘rifati’l-hiyal al-handasiyya). It should also be noted that Russian popular internet publications (which are not based on academic research and are created/reproduced for commercial and personal purposes) were excluded from the assessment. One of the ṣaḥābīs of Prophet Muḥammad is ʿUrwa b. Masʿūd from the Ṭāʾif tribe of Thaqīf. He belongs to the Ahlâf part of the Thaqīf tribe and he is the ruler of this part. ʿUrwa’s ancestry is known without any controversy until Kasî (Thaqīf). According to a narrative his epithet was Abū Yaʿfur and another of his epithet was Abū Masʿūd. Father of ʿUrwa an important person too. He is one of the leaders of his tribe and he commanded (...) his part (Aḥlāf) in wars of Fijār. Mother of ʿUrwa is Subay’a bt. ʿAbd Shams from Banū Umayya. In this way ʿUrwa has kinship both with Banū Umayya and Prophet Muḥammad. So ʿUrwa has a very important position because of his lineage, his mother and father. Thefore, his connections with Mecca and Quraysh strengthens his position. In our sources there is no information about his dates of birth and death. It is likely to be over middle age when he became a muslim, considering that he was the leader of his tribe and his son become a muslim after he died. There is too little information about weddings of ʿUrwa. According to narratives, he had ten wives before becoming Muslim. After becoming a Muslim Prophet Muḥammad warned from him to prefer four out of ten wives. One of his four wives is the daughter of Abū Sufyān. Howev-er, there is no information about the names of his wives. Names of his sons: ʿĀṣim, Abū Murra, Abū Mulayḥ, Dāwūd, Hammām and Hishām and names of his daughters: Umm Saʿīd (married with Ḥaẓrat ʿAlī) and Ḥalīma. We could see he served as embassy before the treaty of Hudaybiyah. His embassy duty shows us the superiority of his position. Also, this embassy duty was very effective at peace negotiations. He mentioned kinship relations which connects about Mecca. He said that it could be beneficial to talk to Prophet Muḥammad himself. The Meccans mentioned about their trust in ʿUrwa. During the time of his embassy, he expressed that both sides should be away from war. In this context, he told the Meccans: The people around Prophet Muḥammad are very loyal to him and he told to Prophet Muḥammad: People around him could disintegrate easily. This mission shows us he is intelligent, respectable and had high persuasion skills. ʿUrwa, observed loyalty of ṣaḥābīs to Prophet Muḥammad. He confessed this loyalty can not be for any ruler. This observa-tion probably affected ʿUrwa’s conversion to Islam. Because of the conquest of Meccah and the events that followed, the people of Ṭāʾif were very worried. Because of this reason people of Ṭāʾif took part in the side of Hawāzin’s and they bat-tled with Muslims. In this time they sent ʿUrwa b. Masʿūd and Ghaylān b. Salama to the city of D̲j̲aras̲h̲ of Yemen, to learn about some war machines and techniques. Therefore they did not join wars of Hunayn and Ṭāʾif. Prophet Muḥammad ended the siege of Ṭāʾif and went to Medina. Meanwhile, ʿUrwa and his friend returned from Yemen. According to narratives when the Prophet Muḥammad returned Medina or he was way in Medina ʿUrwa visited him and became Muslim. Some people tell about the date of ʿUrwa’s being Muslim at before or after Abū Bakr’s emirate of Hadj. However, when the narrations are examined, it can be said he became Muslim after four or five months from Prophet’s siege of Ṭāʾif and before three or four months from Tabūk expedition of Rabīʿ al-awwal or “Rabīʿ al-ākhir” (July or August) in the year 9/630. As for the conversion of ʿUrwa, basic sources report that “Allah, inspired Islam to the heart of ʿUrwa and he changed his situation. He went to the Messenger of Allah and he became Muslim.” They do not give a specific reason. But after this period the narratives tell the reason for ʿUrwa’s becoming a Muslim as due to an experience he had while travelling to Najrān for trade. In this travel, two mysterious young girls and the priest in Najrān said the last prophet came and ʿUrwa must be subject to him and ʿUrwa became Muslim after he returned. But this narrative is prob-lematic with regard to evidence and text. After being Muslim, ʿUrwa wanted permission from the Prophet to invite his tribe to accept Islam. The prophet did not want to accept this at first. Because the people of Ṭāʾif had an arro-gant stance against Islam, and he said that the people of Thaqīf could kill ʿUrwa. Eventually ʿUrwa went to his hometown with permission of Prophet and invited people to Islam and they did not accept this invitation and cursed ʿUrwa. The next morning ʿUrwa read adhan of fajr and people of Ṭāʾif killed him. ʿUrwa b. Masʿūd was likened to Prophet Jesus by the Prophet Muḥammad. It is generally accept-ed that ʿUrwa b. Masʿūd el-Thaqafī is “one of the biggest from two cities” expressed in sūra Zukhruf. Only two weak narrations were reported of Urwa who could live as a Muslim for a few days and was matyred by his tribe. (shrink)

After the belief in Allah and in the necessities of His religion, the first of our duties towards Him is to learn our responsibilities as an ‘abd [servant] and worshipping according to His will. Worship is to do what Allah commands and not to do what He prohibits. Worship is legislated by Allah and His Prophet. Thus, the unity and solidarity in worship is achieved. Some reasons and causes for worships are known however the main purpose of worshipping is to (...) serve Allah. Not all the worships are bound with a standard reward scale. Allah has put some standard reward scales as a result of His grace and blessings on His servants. The most common of these is ten-to-one. Worships like az-Zakah [obligatory charity] and as-Sadaqa [voluntary charity] are given seven hundreds -to-one or more reward. Iḥyaʾ Laylat al-Qadr (keeping vigil in that night) is equal to worshipping in a thousand months. In addition, there are unlimited and uncounted blessings in this World and in the hereafter. Also the reward of the worships (like prayer, fasting, giving charity and pilgrimage) is determined by Allah and is subjected to special reward scales. He is who determines the worships and their rewards. One of the greatest blessings of Allah to His slaves is Tawbah [repentance from sins] which means a chance for human beings to make themselves forgiven. Also there is ar-Riya’ [showing off, insincerity] which annuls the worship and limits its reward to this World only. (shrink)

This alleged hiddenness is particularly troublesome for evangelical Christianity, much more so than generally recognized, for it would render certain facts about the world and about the Bible very hard to explain on the hypothesis that the God of evangelical Christianity exists. Those facts would be best explained by appeal to the alternate hypothesis that that deity does not exist. Three evidential, epistemic, atheological arguments emerge from this consideration. One of them is the (...) Argument from Nonbelief, which focuses on the fact that there is widespread nonbelief in the given deity. I have written essays and a book (NONBELIEF & EVIL) on that one. The other two are the Argument from Confusion (to be labeled AC) and the Argument from Biblical Defects (ABD). AC focuses on the fact that there is widespread confusion among Christians regarding important doctrinal issues, including morality and salvation. The study discusses the correct name of one of Abd al-Abbas Iranshahri's books. The book is based on Bayan al-Adyan (بیان‌الادیان) authored by Abolma’ali Mohammad Balkhi, which has been called "Hastishenasi". Looking on the different meanings and interpretations of "Hasti" in Persian language and culture and the understanding of early scholars of Islam, the real name of the book seems to be "Hasti-Dad". It is emphasized in the study on the importance of Iranian's due attention to Persian and that many (...) intellectuals found it necessary to have a heavenly book in Persian to explain and interpret the principles of Iran's historical and mythological beliefs. So, those who did not want a religion other than Islam in Iran, translated Qur'an, the holy book of Islam, into Persian in the Samanid period. (shrink)

In M.Nesprava’s article "Theoretical Foundations of Radical Salafism", the presence of a conceptual core in the radical Salafism doctrine is shown and the main formation stages of this core are analyzed. Also, the role of the ideas by such authors as Ahmad ibn Hanbal, Muhammad ibn ʿAbd al- Wahhab, Syed Abul A'la Maududi and Sayyid Qutb in the formation of the conceptual core is argued. Senior high school is known to be part of the newly implemented K-12 program in the Philippines' educational system. Hence, this program added two years to the academic learning program of students, which mainly focuses on different theoretical and vocational strands that aim to prepare and fully furnish the students for education and employment in the future. Due to adjustments to new online learning amidst the pandemic, students begin to experience various challenges, primarily social support and mental well-being. Hence, this (...) study investigates the relationship between social support and anxiety with 160 respondents from private schools. The findings revealed that social support and anxiety have a significant relationship (r=0.126). (shrink)
